California Proposit§ ™ion 65(Prop 65) is the ≤♥δ‘Safe Drinking Water and Toxic En< forcement Act of 1986’, a ba™>∞♣llot initiative passed over←∑ whelmingly by Californian residents inα≤∞ November 1986. This unique right-≈© to-know law requires the state to publiφsh a list of chemicals that are known t¶↓♥o cause cancer, birth defects a☆♠←nd/or reproductive har>$m. First published in 1987←☆∑, the list has evolvπ↕ed to over 900 chemi>§γcals. The law requires businesses offe÷→λring products or services in Ca εlifornia that may expose a persoσ♥n to a listed chemical above a sa₩≥fe level to provide a “clear and •∑reasonable” warning prior to such∏φ exposure.
Chromium(VI) ‘s Harm
Chromium (hexavalent compounds, Cr (V↔♥♣I)) has been listed asγδ a chemical to cause cancer, birth defeσ$cts, and other reproductive tox ™icity since 1987. Chromium✔₩♠ is the most versatile tanning €₽>agent. However, under certain£₹"≥ production and storage condition¶♦βs, chromium III can be converted to chrπ₹וomium VI, which can easilγ<↓πy trigger allergic re∞£≥actions and cause skin ulcers→→, tumors or even skin cancer.
Recent Enforcement
There has been no settle₩→ ment on Cr (VI) on textil♥< es, footwear or accessories ↔"&products since then. Since th©≈↕e beginning of last ☆♦≈year, there have been m™"any 60-day notices issued i≠n relation to the presence of "∞<∑Cr (VI) in leather goo↑∑ds. Among them, two 60-day notic✘≥♥es led to a settlement and a conse™<₽nt judgement issued to addres©→γs consumer exposures φ♣Ωto Cr (VI) in leather glov ≥¶es. These enforcements requi"☆∑♥re a clear and reasonab↔ →le warning label to be displayed on t§¥✔he covered leather gloves that contain '"Cr (VI). Recently, ☆÷→hexavalent chromium compα$₽ounds has become a frequent Prop £∞✔×65 target for gloves ma±$de with leather. It is alleg® ✔ed that some leather gloves in the♥£™ market contain hexava♠≠★lent chromium compounds, which are ♠ε≈considered under the law to poseσ☆® a risk to the consumer.÷±ε As part of Prop 65, businesses selγ♣≥ling products in California mu γst provide “clear and reasonaγ♠ble warning” before knowi±"ngly exposing people to any chemical onβ≈↓π the list, unless the expected l∑•evel of exposure would®§∞ pose no significant cancer ris≠γ♥k.
The 60-day Notice of Viola tion is a legal document that₽≥£π often leads to settlement negotiat≈δ>ions. Once the relevant s♠€×♣ettlement agreement ©₹or judgment is reached, it is required¥♠ that the product man×®∏ufacturer either refor₹¥mulate the product or provide a wa<σ$rning label.
